Question: There is a brother in financial difficulty and someone has approached him with money so that he can offer Hajj on behalf of a deceased person. Knowing that the person has not already performed his obligatory Hajj, would the deceased brother get the rewards from this person performing Hajj on his behalf?

Answer: It is valid to delegate someone upon whom the Hajj is not obligatory - like the poor. This is a correct opinion. Therefore in this case - he is mentioning that the brother is in financial difficulty; so if the brother is poor, then Hajj is not obligatory upon him so, delegating him is valid according to the correct opinion.
